Q. After I file the motion to get my firearms back in New Hampshire courts related to my domestic violence charge, what happens?
A. The judge typically requires the Defendant to personally appear for a court hearing. As of January 2026, the Court completes ATF From 4473 and calls the Gun Report Hotline to complete an updated background check. The Department of Safety will typically respond to the Court in response to their inquiry. The Court will also review the protective orders, acknowledgement forms, and all court orders which caused the gun/firearm to be taken from the Defendant associated with the restraining order, criminal charge or bail condition. After the Court hearing, a decision is made to allow or deny the firearm return.
