A. Each case is different. Most of our clients receive their blood test result at hospitals. Some have them taken at roadblocks by a certified individual. The results can take time to receive from the State of New Hampshire. It's important to deal with the testing ASAP. Law Enforcement will only hold samples for secondary analysis for a limited time. Then they throw them away.
Just because the police say you tested over the limits, doesn't mean a Court of law will agree. Attorney Clark has his expert chemist pick up all blood tubes for analysis by his certified independent chemist. Law enforcements blood tests may be thrown out based on our chemist findings. This can also be helpful on Aggravated DWI and DUI charges.
There are many methods Attorney Clark uses to suppress evidence in DUI representation. Some of these include improper Chain of Custody, lack of reasonable timing in administering the testing, determination of whether the State's standards were strictly followed to protect the integrity of the blood sample, and that all testing was done in accordance with the NH Department of Safety Rules.
